What Factors Are Considered in Making an Alimony Award?

Getting financial support after a divorce may be necessary for one spouse, but the other spouse may still resist making alimony payments. It is very important to negotiate any alimony payments while the divorce is pending — it is usually a much more efficient way to come to an agreement. If the spouses cannot agree on divorce maintenance payments and intend to fight it out in court, it can be a lengthy and expensive process.

If the question of alimony is brought before the court, the court will look at the following factors, among others, to decide whether an alimony award is appropriate:

  • How long did the marriage last?
  • Did the marriage end due to one spouse's marital misconduct?
  • What is the age and health of each spouse?
  • What is the occupation and income of each spouse?
  • If either spouse is unemployed, what are the work skills and employability of the unemployed spouse?
  • What are the assets and the sources of the assets of the parties?
  • How will the marital assets be divided? Equally or unequally?
  • If one parent has total physical custody of the children, is it realistic for that parent to work outside the home?
