Dissolution of Connecticut Civil Unions

Where Must a Connecticut Civil Union Be Dissolved?

It is still unclear whether Connecticut civil unions must be dissolved in Connecticut courts. It may be possible to obtain a dissolution from a court in another state that legally recognizes the relationships of same-sex couples — for example, Vermont, New Jersey, Massachusetts or California. This area of the law is still evolving as more states recognize the legal validity of same-sex relationships.

Residency Requirement for Civil Union Dissolution

Just as with a divorce, there are residency requirements that at least one party must satisfy before dissolving a civil union in Connecticut. One of the following three requirements must be met:

  • One partner must have 12-months' Connecticut residency before the complaint for dissolution is filed or before the decree of dissolution is issued.
  • At least one partner was a Connecticut resident when the civil union began and has come back to Connecticut with the intention to remain permanently in the state.
  • The cause for the dissolution arose after either partner moved into Connecticut.
